These Conditions of Sale govern the offer and sale to the consumer of products through the website flexbed.com (hereinafter the "Site") property of Flexbed S.r.l. and are formulated and provided in compliance with the provisions of Legislative Decree 6 September 2005 n.2016 (so-called "Consumer Code") and any other law applicable to electronic commerce.

It is your right to request additional information through our assistance services by contacting Customer Service. Furthermore, for any other information of a legal nature regarding the use of the site and purchases made through the site, you can consult the sections: Terms of use, Privacy Policy, Cookies, Shipping and Deliveries, Payments, Right of Withdrawal, Legal guarantee of compliance, which we invite you to periodically consult these Conditions of Sale to check for any updates or changes.

The parties to the contract are:

- The "Customer" (Customer): or any natural person, company that makes purchases through the Site;

These Conditions of Sale do not regulate the supply of services or the sale of products by parties other than Flexbed that may be present on the Site through links, banners or other hypertext links. Before placing orders and purchasing products and services from subjects other than Flexbed, we advise you to check their conditions of sale, because Flexbed is not responsible for the provision of services by such subjects or for the conclusion of e-commerce transactions between the users of the Site and third parties.

Before making purchases through the Site, the Customer declares to have read and understood these Conditions of Sale as well as all the information provided during the purchase procedure and the contents of the following sections: Terms of use, Privacy Policy and to accept them in full without any reservation.

Flexbed reserves the right to change the contents of these Conditions of Sale and the other documents listed above, highlighting them within the Site. We therefore invite you to periodically consult the Site to check for any updates or changes. Any changes will be effective after publication on the Site.

The Conditions of Sale applicable to a purchase will always be those in force at the time the relative order is placed.

Flexbed offers for sale on the Site exclusively products marked by trademarks owned by them and / or licensed to it or in any case with the authorization of their respective owners. Flexbed does not sell used, irregular or inferior quality products on the Site to the corresponding standards offered on the market.

The essential characteristics of the products are presented on the Site within each product sheet. The images and colors of the products offered for sale on the Site may however change and / or not exactly correspond to the real ones due to the Internet browser and monitor used.

The products are offered for sale at the price indicated on the Site at the time the relevant Purchase Order is placed. Product prices may be subject to changes and variations. We invite you to check the final sale price before submitting the relevant order form, thus confirming the purchase.

The prices indicated on the Site must be understood as excluding VAT and, unless expressly indicated, do not include any additional costs for shipping and delivery which, where applicable, are in any case made known to the Customer through specific indications on the Site and specifically referred to in the course. of the purchase procedure.

To purchase one or more products on the Site, the Customer must complete and electronically transmit the respective order form to Flexbed (hereinafter "Purchase Order") following the instructions progressively provided during the purchase procedure. All phases of the purchase procedure are clearly described through the pages of the Site and the related texts and graphics.

The Purchase Order, displayed in its entirety immediately before the conclusion of the contract and in any case before any payment is made, provides summary information about the essential characteristics of each product ordered, the price (including all taxes or applicable taxes) and any applicable shipping costs and / or charges.

With the electronic transmission of the Purchase Order, the Customer unconditionally accepts and undertakes to observe these Conditions of Sale in relations with Flexbed regarding the purchase. If you do not agree with some of the terms set out in the Conditions of Sale, we therefore invite you not to submit the Purchase Order.

Following the receipt of the Purchase Order, Flexbed will check the availability of the ordered product and will send the Customer by e-mail a confirmation of receipt containing these Conditions of Sale, including the provisions relating to the right of withdrawal, and therefore all the information already contained in the summary of the commercial and contractual conditions displayed before sending the Purchase Order.

The sales contract is considered concluded and perfected when Flexbed electronically sends the Customer the confirmation of receipt of the Purchase Order completed and sent by the Customer, after verifying the correctness of the data provided and transmitted.

The Purchase Order will be filed in our database for the period of time necessary for processing and in any case not beyond the terms of the law.

Flexbed reserves the right not to process Purchase Orders that are incomplete or incorrect or inconsistent with the commercial policy referred to in paragraph 1 of these Conditions of Sale, as well as in the event of unavailability of the ordered products. In these cases we will inform you that the contract has not been concluded and that Flexbed has not followed up the Purchase Order specifying the reasons.

In particular, if the products presented on the Site are no longer available or on sale at the time of your access to the Site, or at the time of sending the order form, Flexbed will promptly notify you of any unavailability of the Products. In such cases the contract will not be finalized and, if already concluded for any reason, it will be automatically terminated and no amount will be charged to you.

Any contractual or extra-contractual liability for direct or indirect damage to persons and / or things caused by the non-acceptance of an order for the above reasons is expressly excluded.

Through the "Bookable Product" service you can purchase any products not available at the time of the transmission of the Purchase Order, which Flexbed undertakes to ship once available.

Once the Purchase Order has been electronically received by means of a reservation filled in and transmitted by you and after verifying the correctness of the data provided and transmitted, Flexbed will send within one day of the conclusion of the procedure an e-mail communication containing information about the product availability, shipping and delivery.

By sending the aforementioned communication, the purchase contract will be considered perfected.

For anything not specifically described in this paragraph, these Conditions of Sale are reserved and will apply.

The products available and purchased through the Site will be delivered by Flexbed by courier to the address indicated in the Purchase Order within 5/6 (five / six) working days from the time the contract is concluded.

If the products purchased through the Site are limited editions, or the related contract is concluded as part of promotional initiatives, during prize events or temporary initiatives of any kind, Flexbed does not guarantee delivery within the terms indicated above.
In these cases the delivery period may vary according to the availability of the product or the characteristics of the promotion. These changes will be duly communicated by Flexbed on the Site and / or by sending e-mails or other methods of communication.

In the event that the courier fails to deliver for any reason, he will leave a notice of passage showing the useful numbers to set a new delivery date. The courier delivers from Monday to Friday from 9:00 to 18:00.

Shipping costs differ according to the items purchased and are always well indicated during the purchase process.

Payment for orders can be made:

(i) by credit card: Visa / MasterCard / American Express;

(ii) cash on delivery, paying in cash directly into the hands of the courier appointed by Flexbed at the time of delivery of the goods;

(iii) by bank transfer using the coordinates that are indicated in the order confirmation email that will be sent at the end of the purchase process. Payment must be made within 5 days of order confirmation, at the end of the term the order will be considered canceled.

(iiii) through the Paypal platform, selecting it during the purchase procedure, you will be redirected to the secure Paypal servers where, by logging in with your credentials, you can complete the payment by charging your credit card, current account or electronic purse.

In case of payment by credit card, the price for the purchase of the products and any shipping costs will be charged order confirmation e-mail.

In case of payment with Paypal, the actual charge will take place when Flexbed sends the order confirmation e-mail

The financial information (for example, the credit / debit card number or its expiry date) will be forwarded, via encrypted protocol, to the banks that provide the related remote electronic payment services, without third parties being able to have you in any way. access. Furthermore, this information will never be used by Flexbed except to complete the procedures relating to your purchase and to issue the relative refunds in the event of any product returns, following the exercise of your right of withdrawal, or if it becomes necessary. prevent or report to the police the commission of fraud through the Site.

Before completing the order, you will be entitled to request the issuance of a tax invoice as indicated during the purchase procedure. We inform you that it will not be possible to request an invoice once the procedure has been completed and the relevant Purchase Order has been sent.

The Customer has the right to withdraw from the contract by means of a communication designed to allow identification of the Customer and the contract, to be sent by registered letter with acknowledgment of receipt to the following address:

The withdrawal is effective only if exercised no later than 30 days from the date of delivery of the products. Flexbed, as soon as it receives the notice of withdrawal, will without delay contact the Customer by telephone and / or email in order to communicate the address of the place where the products must be returned; the Consumer will then take care of the return of the products to Flexbed in accordance with these indications no later than the following 14 days. Flexbed, within the times and methods agreed with the customer, will fully refund the amount paid by the customer. The costs of returning the products to Flexbed are charged to the customer.

An essential condition for exercising the right of withdrawal is the substantial integrity of the products to be returned.

The Conditions of Sale are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206 (so-called Consumer Code), with specific reference to the legislation on distance contracts and the legislative decree 9 April 2003 n. 70 on certain aspects concerning trade.

The competent court for the resolution of any dispute will be that provided for by the Italian legislation in force at the time of the conclusion of the contract.
